1. Acceptance of Terms
By accessing or using the Awaiit application ("the App"), provided by Awaiit ("we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must immediately cease all use of the App.
Your Privacy MattersThese Terms are paired with our Privacy Policy, which explains in plain language how we collect, store, and protect your data — including your location, account details, and submitted reports. We encourage you to read it.
2. Eligibility and Account Security
You must be at least 13 years of age to use this App. Users under 18 represent that they have obtained parental or guardian consent.
You are responsible for maintaining the confidentiality of your credentials. You agree to notify us immediately of any unauthorized use of your account.
3. User Conduct and Crowdsourced Data
Awaiit is a community-driven platform. By using the App, you agree to the following:
You agree to provide wait-time reports that are, to the best of your knowledge, accurate and truthful.
Submitting false data to intentionally damage a business's reputation or to manipulate the App's proprietary data processing models is strictly prohibited.
The App utilizes GPS verification and geo-fencing to validate reports. Attempting to bypass, "spoof," or otherwise manipulate location requirements is a material breach of these Terms.
4. Intellectual Property and Virtual Rewards
All content, features, and functionality — including the Awaiit name, logos, proprietary algorithms, and backend architecture — are the exclusive property of Awaiit.
XP points, Trust Scores, and badges are for entertainment and gamification purposes only. They have no cash value and do not constitute personal property. We reserve the right to modify or delete these rewards at any time without notice or compensation.
5. Prohibited Activities
You are strictly prohibited from:
Engaging in any activity that disrupts the App's servers, including DDoS attacks, SQL injection, or unauthorized API access.
Using automated systems (bots, spiders, or scrapers) to extract data from the App for any purpose.
Attempting to decompile or reverse engineer the App's proprietary logic, hosted on third-party infrastructure (including Vercel and Supabase).
6. Disclaimers and Limitation of Liability
Awaiit provides wait-time estimates based on crowdsourced data. We do not guarantee that any estimate is 100% accurate.
We are not liable for any loss of time, missed appointments, or financial damages resulting from reliance on the information provided in the App.
To the maximum extent permitted by law, Awaiit shall not be liable for any indirect, incidental, or punitive damages, or any loss of profits or revenues.
7. Indemnification
You agree to defend, indemnify, and hold harmless Awaiit and its developers from and against any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your submission of fraudulent data.
8. Termination and Discretionary Power
We reserve the absolute right to:
We may terminate your access immediately, without notice, for any breach of these Terms.
We may delete any user-submitted data, XP, or Trust Scores if we believe the data is inaccurate or harmful to the community.
9. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of New Jersey, without regard to its conflict of law provisions.
Any dispute arising from these Terms shall be resolved through binding arbitration in the State of New Jersey.
You agree to resolve disputes with us on an individual basis and waive your right to participate in a class-action lawsuit or class-wide arbitration.
